These Terms of Service (“Terms”) govern your access to and use of the website, software, and services provided by KJR Digital Marketing, LLC (“KJR,” “we,” “us,” or “our”), including kjrdigitalmarketing.com, done-for-you marketing services, white-label software resale of EmailClik and Client System Pro, and the Unlimited Leads community (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts

Some Services require an account. You agree to provide accurate information, keep your credentials secure, and notify us immediately of any unauthorized access. You are responsible for all activity under your account.

3. Services

a. Done-For-You Services

Our marketing services (including list building, SEO/AEO/GEO/LLMO, paid ads, GoHighLevel setup, VPS setup, Google Business Profile setup, and affiliate program management) are governed by a separate written agreement or statement of work (“SOW”) that you sign before we begin work. In the event of conflict, the SOW controls.

b. Software (EmailClik & Client System Pro)

Software purchases are governed by the applicable product's subscription terms, which you accept at checkout. White-label resale arrangements require a separate reseller agreement.

c. Unlimited Leads (Skool Community)

Access to Unlimited Leads is provided through the Skool platform and subject to Skool's terms in addition to these Terms.

4. Payment

Fees, billing frequency, refund eligibility, and cancellation terms are disclosed at the point of purchase or in your SOW. Unless otherwise stated:

• All fees are quoted and charged in U.S. dollars and are non-refundable except where required by law or expressly stated.
• Subscriptions renew automatically until canceled; cancel any time through your account or by contacting support.
• Failure to pay may result in suspension or termination of Services.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose, including violating anti-spam laws (CAN-SPAM, CASL, GDPR ePrivacy) or sending content you don't have the right to send.
• Scrape, reverse engineer, or circumvent security measures of the Services.
• Upload malicious code, infringing content, or content that is defamatory, harassing, or obscene.
• Resell or white-label our software without a written reseller agreement.
• Use the Services to compete directly with us or to build a competing product.

We may suspend or terminate Services for violations, with or without notice.

6. Intellectual Property

All content on the Services — including text, graphics, logos, software code, courses, templates, and SOPs — is owned by KJR or our licensors and protected by applicable IP laws. You receive a limited, non-exclusive, non-transferable license to use the Services solely as permitted by these Terms.

Content you submit remains yours; you grant KJR a worldwide, royalty-free license to use it solely to provide the Services to you.

7. Deliverables & Work Product

For done-for-you engagements, ownership of deliverables (campaigns, creative, lists, funnels) transfers to you upon full payment unless your SOW states otherwise. KJR retains the right to use deliverables in anonymized form for portfolio and case study purposes.

8. Results Disclaimer

No guarantees. Marketing results depend on many factors outside our control — your offer, market, timing, execution, and platform algorithms. Testimonials, case studies, and examples on this site reflect individual experiences and are not guarantees of similar results. You are solely responsible for the financial decisions you make using information from the Services.

9. Affiliate Links & Third-Party Products

Some links on the Services are affiliate links (for example, to Blotato and Dialora). We may earn a commission at no additional cost to you when you purchase through those links. We only recommend products we use and believe in, but we are not responsible for the performance, support, or business practices of third-party vendors.

10. Third-Party Platforms

The Services integrate with or depend on third-party platforms (Skool, Stripe, Google, Meta, GoHighLevel, etc.). Your use of those platforms is governed by their own terms. We are not liable for their downtime, policy changes, or actions.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, KJR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KJR'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID KJR IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (b) ONE HUNDRED U.S. DOLLARS (US$100). KJR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

13. Indemnification

You agree to indemnify and hold harmless KJR and its affiliates, officers, and employees from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. You may stop using the Services at any time. Sections that by their nature should survive termination (ownership, disclaimers, limitations, indemnification, dispute resolution) will survive.

15. Governing Law & Dispute Resolution
